1. Acceptance of Terms
By accessing or using the IsThereSomebody application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
2. Privacy Policy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy carefully to understand how we collect, use, and disclose your personal information.
3. Registration and Account Security
To access certain features of the App, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised access to or use of your account.
4. Use of the App
You agree to use the App in accordance with these Terms, our Privacy Policy, and all applicable laws and regulations. You may only use the App for lawful purposes and in a manner consistent with the intended use of the App.
5. Content and Conduct
You are solely responsible for all content that you upload, post, transmit, or otherwise make available on or through the App ("User Content"). You agree not to upload, post, or transmit any User Content that:
- Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libellous, invasive of another's privacy, or otherwise objectionable;
- Infringes any intellectual property rights or other rights of any party;
- Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment;
- Violates any applicable laws or regulations.
We take a zero tolerance approach to any violations of our content and conduct terms, and will permanently remove users who violate them from IsThereSomebody permanently.
You warrant that, for every piece of User Content you post, you have the right to post it, and that you will not include details that identify a third party — in particular, that you will not name or otherwise identify the person whose addiction you are writing about.
6. Your Content and the Licence You Grant Us
You own the content you create. Posting User Content on IsThereSomebody does not transfer ownership of it to us, and you keep every right in it that you had before.
So that we can run and promote the service, you grant IsThereSomebody a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, publish, display, distribute, excerpt and adapt your User Content, in the App, on our public website, and in material promoting the service. Adaptation and excerpting are limited to what publication requires — for example shortening a post for a search result summary or a page preview, and replacing your nickname with the anonymised byline described in our Privacy Policy.
This licence exists only for the purpose of operating and promoting the service. It is not perpetual, irrevocable or transferable: when you delete your User Content, the licence ends, except to the extent of copies already distributed to, cached by or indexed by third parties, which we cannot recall.
Our Privacy Policy explains which posts are published on our public website, what is withheld, and how to have content removed.
7. Our Intellectual Property
The materials we provide — including the text, graphics, logos, button icons, images, audio clips, digital downloads and data compilations that make up the App and the website, but excluding User Content — are the property of IsThereSomebody or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not modify, reproduce, distribute, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of those materials, except as necessary for your own personal, non-commercial use. This section does not affect your ownership of your own User Content, which is dealt with in Section 6.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ISTHERESOMEBODY, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING ANY DAMAGES RESULTING FROM LOSS OF USE, DATA, OR PROFITS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ISTHERESOMEBODY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. Indemnification
You agree to indemnify, defend, and hold harmless IsThereSomebody, its affiliates, and their respective officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable solicitors' fees) arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of any other person or entity.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without giving effect to any choice or conflict of law provision or rule.
11. Changes to Terms
IsThereSomebody reserves the right to modify or revise these Terms at any time. Any such changes will be effective immediately upon posting the revised Terms on the App. Your continued use of the App following the posting of the revised Terms constitutes your acceptance of such changes.
